Note: this document is a working draft. Have a lawyer review it before using it as a binding agreement with customers. The specific limits of liability, jurisdiction, and termination clauses in particular should be customised for your business.
By creating an account or using KinsWell (the “Service”), you agree to these terms and our Privacy Policy. If you don’t agree, don’t use the Service.
The Service exists to coordinate care for a person resident in New Zealand. By creating a household, you confirm that the person whose care you are coordinating is resident in New Zealand, and that care delivery — the carers, the visits, the home — takes place in New Zealand.
Family members, friends, and other care contributors who use the Service to support that person may be located anywhere in the world.
The Service is not directed at users outside this scope. If you sign up to coordinate care for someone outside New Zealand, you may not receive the benefit of consumer protections in your jurisdiction, and we make no representations about the Service’s compliance with the laws of any other country.
The Service is not intended for children under 13. If you become aware that a child has signed up, please contact us.
KinsWell is a care coordination tool. It records tasks, visits, medications, notes, photos, and messages to help family members and care providers coordinate the care of a loved one. It is not a medical record, not a substitute for professional medical advice, and not a regulated health service.
You must be at least 18 years old to create an account. You are responsible for keeping your password, carer PIN, and QR code confidential. You are responsible for every action taken from your account.
If you believe someone has accessed your account without permission, contact us at support@kinswell.nz immediately.
KinsWell charges a monthly subscription fee based on the tier you select. You can change or cancel your subscription at any time. Fees are charged in advance and are non-refundable for partial months unless required by law.
You agree not to:
You grant KinsWell a limited licence to store and display your content so we can provide the Service to you and the other people you’ve invited to your household.
You can terminate your account at any time from the Account page. We can suspend or terminate accounts that violate these terms.
The Service is provided “as is”. We don’t guarantee it will be uninterrupted, error-free, or suitable for any particular purpose, including any medical or clinical purpose. You are responsible for the care decisions made using information in KinsWell.
KinsWell is a care-coordination platform. It is not a clinical record, prescription system, or medication-management tool. All information about a person’s medication, dosing, and schedule must be verified against the pharmacy’s blister-pack labelling and the care plan from the prescribing clinician. We make no representations about the accuracy or completeness of medication information entered by users, and accept no liability for medication errors arising from reliance on the Service. Carers should only administer or assist with medications they are trained and authorised to handle under the laws of their jurisdiction; in New Zealand this generally means assisting with pre-packed Medication Compliance Aids (blister / Webster packs) unless a registered nurse has delegated wider authority under a documented care plan.
To the extent permitted by law, KinsWell is not liable for any indirect, incidental, special, or consequential damages arising out of or related to the Service.
These terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
We may update these terms from time to time. We’ll notify you by email if changes are material. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
